New Precedent Set in the VICP
TDaP and Transverse Myelitis Settlement
Max Muller, one of the firm's founding partners, recently won an important case at trial involving a client who developed transverse myelitis as the result of the Tdap vaccination. The government aggressively defended the case from the beginning, raising two major arguments: (1) we could not prove a medical theory that showed the Tdap vaccine could cause transverse myelitis; and (2) our client’s symptoms began too soon after the vaccine to prove that the vaccine could have caused his injuries. Mr. Muller retained 4 medical experts to aggressively challenge the government's defense including neurologists from University of Pennsylvania and Stanford University and an immunologist from University of California. After 5 years of litigation, the case went to trial in March of 2022. The Special Master decided the case for our client, finding that our experts provided a sound medical theory, and that the Tdap vaccine caused his transverse myelitis.
